By using this website and/or the Build EZ System, you acknowledge and agree to the terms of the Build EZ System, LLC (also referred to as “Build EZ”) Privacy Policy, Terms of Use, and the terms of this Disclaimer, all of which are published on buildezsystem.com and all other websites owned by Build EZ (collectively referred to as the “Site”). If you do not agree to these terms, you are not allowed to use the Site or the Build EZ System.
1) The documents and forms available on the Site are generic documents and/or templates for selfhelp use and were not designed or drafted for a specific area, region, or jurisdiction of the United States or any other country, nor were they designed or drafted for any specific company or user of the Site. 4) The documents and forms available on the Site are copyright protected and are available for confidential and non-commercial company use by subscribing users of the Build EZ System only. Except as stated in this Disclaimer, sharing these documents and forms or using them for any other purpose is illegal and strictly prohibited.
5) Subject to your payment of the applicable fees and compliance with these terms, Build EZ hereby grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and fully revocable license to access and make a personal and confidential non-commercial use of the Build EZ System. The documents and forms included in the Build EZ System may be shared with your legal and business advisors and potential or existing clients and/or modified as you determine to be appropriate, so long as the documents and forms contain the original copyright and confidential notices at all times. This permission becomes null and avoid upon your failure to pay the applicable fees or at the expiration or termination of your Build EZ System subscription.
6) EXCEPT AS PROHIBITED BY LAW, BY USING THE BUILD EZ SYSTEM, ALL USERS AGREE TO HOLD BUILD EZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING ATTORNEYS' FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THIS AGREEMENT AND ANY VIOLATION OF ANY FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF BUILD EZ HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF BUILD EZ, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, IN WHICH CASE, AND ONLY TO THE EXTENT REQUIRED BY EXISTING LAW, SUCH LIMITATION WOULD NOT APPLY.
